I spent a lot of time around Vail in the early 70s.  After being ejected from a store there in the mid 80s due to my riff raff appearance I never went back.  When it came time for me to buy mountain property I didn't consider vail to be an option.  Ive been happy to live in grand county for the last decade.  I'm also overjoyed that the business owners in vail will never see a dime of my money.  Makes me happy every time I think about it. I could not take such cold winters. Wen I was a pastor in Indianapolis in the 1980s, it got down to 26 below zero and the wind steady at 70 mph with gusts going well above that! Being from the deep South, that didn't sit too well with me. That Winter I prayed and asked the LORD if there was a good church back in the deep south that needed a pastor who loved the LORD  and people. Less than a year later I accepted a church in LaGrange, Georgia. It took me about three months to shake all the cold out of me!! &lt;p&gt;the hoa, according to texas non-profit corporation law should have a reserve account and be part of the budget.  there is no reserve account and the hoa spends every penny it takes in (22K per month for 72 units).&lt;/p&gt;

&lt;p&gt;the financials given to residents were just the P&amp;amp;L and "budget" which were unaudited.  There are audited financials but they gave the residents other documents.&lt;/p&gt;

&lt;p&gt;the hoa manager suggested to my neighbor to sue me for damages to her property from years of wear and tear and damages caused by the prior owner of my townhome.  my neighbor did sue me and i turned it over to my insurance carrier who did not want to pay to fight and the insurance carrier gave her 10k.  &lt;/p&gt;

&lt;p&gt;QUESTION: &lt;/p&gt;

&lt;p&gt; Can I countersue for the hoa suing me for the antenna placement? &lt;/p&gt;

&lt;p&gt;Can I sue for lack of fiduciary responsibility?  &lt;/p&gt;

&lt;p&gt;Can I sue for harrassment?&lt;/p&gt;

&lt;p&gt;Furthermore, The HOA manager sent an invoice to a neighbor for 700.00 for sprinkler repair. The attached "backup" documentation was for work done at another townhouse, for work on sewer pipes instead of sprinkler pipes, and the invoiced amount was for much more.  The manager sent this invoice to the trust fund accountant of the neighbor, who, fortunately, forwarded the invoice to the neighbor's family (the neighbor is mentally handicapped).  This was last month and the neighbor has not received any follow-up billing from the HOA manager.&lt;/p&gt;

The neighborhood has been built in 3 or 4 phases and still is not completed with several empty lots. The HOA has been non existent and never ha d a board yet we still paid our $300 for absolutely nothing, none of the common areas were ever maintained correctly and rarely even mowed. The park benches and path areas left to the same rare maintenance. In the last 2 yrs the HOA was handed over and "neighbors" who live in the last phase at the opposite end of the neighborhood jumped on the board and took over as director or CEO what ever he calls himself. He has steadily tried to strip away our rights, he has stated he has personally destroyed some of the benches and structures (benches and gazebo) on the common areas because he does not like them and wants them to go away, These are also in phase 1 and no where near his home. there is a 2nd entry way near his home that the people use to obviously go out the other way, he wants to close that road down to reduce traffic, which would of course force everyone past phase 1 the people who bought 6 yrs before he did. because of emergency access he has had a hard time getting that pushed through, but now he has informed me he is planning on trying to make this a gated community, so he can then restrict the flow going out the backside. He also wants to make an regulation/guideline that everybody has to ask the HOA any time they do any modification of their property or house. He also made comments about how people have put pavers next to their driveways and did I see "the newest checkered one down the road That is disgusting, I'm going to make them remove it" ( It is a very nicely done stone job, that has  azig zag pattern of light and dark bricks). This guy is obsessed with money and how much he is spending on all of the new "improvements" he is making, and how much it costs for the attorney "we" hired, and how much money is owed to the HOA from all the years they did nothing. He is also obsessed with destroying our detention ponds which he lives no where near. The ponds have grown up naturally with trees, cat tails, and wild life, he wants to cut or burn everything out and have it replanted with flowers and "native vegetation" as opposed to the vegetation that grows naturally. This will only cost $8K-$10K.. ?? if we are so behind on money why are you wanting to throw it away on un needed items. This is crazy, how do we prevent his? I have a family with a small child and another on the way, I don't have time to go sit in on board meeting or become a member just to try and protect my rights and try to make sure the house and property I bought does not fall victim to a fascist mini Government. I hear people all the time making comments to others about the HOA, if you didn't want to be in one you shouldn't have bought in one, well my HOA was very limited when I bought and now they are going crazy. Now I have been ruled against , by default ( not showing up to court orded arbitration). Since this has taken place over a few years , with only 1 notification, from thier lawyer, after the fact telling me it was ruled in favor of the hoa.&lt;br&gt;Fast foward to today )3 years later), the hoa's lawyer has placed a tittle lein on my home,( approx. $9000), for assesments , court fees and the lawyer's fee. If I had it all to do again, there is no way in hell I would move into an hoa neighborhood. I can only say the hoa i'm in is greedy,underhanded , deceitful a_ _ holes whom do not deserve spit ifthey were dyeing of thrist!
